1. Agreement and operator
These Terms of Service ('Terms') govern access to the FLΛYR mobile application, website and related services (together, the 'Service') operated by FLAYR INC., an Ontario corporation ('FLAYR', 'we', 'us'). By creating an account, selecting an acceptance control, or using the Service, you agree to these Terms and the Community Guidelines. Our Privacy Policy separately describes how we handle personal information.
If you do not agree, do not use the Service. Additional feature-specific terms may apply if presented before use; in the event of conflict, those specific terms govern only that feature to the extent permitted by law.
2. Eligibility and account registration
FLAYR is an adults-only dating service. You must be at least 18 years old, legally capable of entering into this agreement, and not prohibited by applicable law from using the Service. You may not use FLAYR on behalf of another person or maintain an account after a permanent safety-related ban without our written permission.
You agree to provide accurate age, identity and profile information, keep your account contact information current, safeguard access to your device and verification codes, and notify support@flayr.netif you suspect unauthorized access. Phone or email verification does not guarantee a user's identity or intentions. We may request reasonable information to verify eligibility or investigate abuse.
3. How FLAYR works
FLAYR is a video-first dating platform. Depending on the version and features available to you, the Service may include an Intro Video on your profile, Featured Prompt videos visible in Discover, video replies, reactions, matching, messaging, profile details and sharing features. Feature availability, duration limits, eligibility and visibility may change as the Service evolves.
You understand that content shown in Discover may be viewed by other eligible users and that profile videos may be viewed by people who visit your profile, subject to any controls actually provided in the Service. Other users may record or redistribute what they see despite our rules. Do not include information you are uncomfortable sharing.
4. Your content and license
You retain any rights you own in videos, images, voice recordings, text, prompts and other content you submit ('User Content'). You are responsible for your content and represent that you have the necessary rights and permissions, including from anyone appearing in it. Do not upload copyrighted material, private images, or another person's likeness without authorization.
To operate and improve the Service, you grant FLAYR a non-exclusive, worldwide, royalty-free, sublicensable license, for as long as necessary to provide the Service and for lawful retention periods, to host, store, reproduce, encode, adapt for technical formatting, display, transmit and make your User Content available in accordance with your settings and Service features. This license does not transfer ownership. Promotional use outside ordinary operation of the Service will require any additional permission required by law.
If you use a sharing function, the recipient or external platform may retain a copy after you delete your content from FLAYR. We cannot guarantee deletion of copies outside our control.
5. Acceptable use and prohibited conduct
You must comply with our Community Guidelines, which form part of these Terms. Prohibited activity includes impersonation; misleading or synthetic identity content; harassment, threats or hate; stalking; sexual exploitation; non-consensual intimate content; content involving minors; fraud, solicitation and spam; unauthorized scraping; interference with security; and unlawful activity.
You may not sell or transfer your account, access another user's account without authorization, circumvent bans or technical limits, or use automated systems to collect user information. Respect others' boundaries and do not pressure users to share intimate content or move off-platform.
6. Reports, moderation and enforcement
You may report concerns through any available in-app reporting feature or email support@flayr.net. We may, where lawful and appropriate, review reported content and associated account information, restrict visibility, remove content, issue warnings, suspend or terminate accounts, preserve evidence, and refer urgent threats or suspected illegal activity to appropriate authorities.
Moderation decisions may be based on context, available evidence and safety considerations; not every report will lead to removal. If you believe we acted in error, contact support@flayr.net with relevant details. We cannot promise a particular outcome or response time. We may withhold details where necessary to protect privacy or safety.
7. Dating safety and offline meetings
FLAYR facilitates introductions; it does not supervise users or in-person meetings, guarantee compatibility, verify every statement on a profile, or guarantee that users have no criminal history. Unless expressly disclosed for a specific feature, do not assume that criminal background checks have been performed.
Use caution when sharing personal information or arranging meetings. Meet in public, tell someone you trust where you are going, arrange your own transportation and report threatening or abusive conduct. In an emergency, contact local emergency services first.
8. Privacy, communications and location
Our Privacy Policy describes collection, use, disclosure, retention and rights concerning personal information. By using optional device features such as camera, microphone, notifications or location, you may be asked to grant device-level permissions. You can manage permissions in your device settings, although certain features may stop working.
We may send essential account, security, verification and service communications. Promotional communications, if offered, will be subject to applicable consent and unsubscribe requirements.
9. Payments and paid features
If FLAYR offers subscriptions, boosts or other paid features, prices, billing frequency, renewal terms, cancellation methods and any applicable refund rules will be shown before purchase. Purchases made through Apple or Google may also be governed by the relevant store's payment terms. Nothing in these Terms limits mandatory consumer rights.
Do not assume a paid feature exists until it is offered in the app. Any future paid product may have additional terms disclosed at purchase.
10. FLAYR intellectual property and third parties
Except for User Content and third-party materials, the Service's software, layout, logos, trademarks, copy and other materials belong to FLAYR or its licensors. We grant you a limited, revocable, non-transferable license to use the Service for lawful personal dating purposes, subject to these Terms.
Third-party services or links may have separate terms and privacy practices. We do not control third-party platforms and are not responsible for their independent actions to the extent permitted by law.
11. Account closure and data deletion
You may delete your account directly in the FLAYR app at any time. Deletion removes your profile, personal information and associated user-generated content from FLAYR's active systems. Limited records or backups may remain for lawful retention purposes or until routine backup expiration, as explained in the Privacy Policy. Copies independently saved by others cannot necessarily be recalled.
We may restrict or terminate access for violations, safety risks, fraud, legal requirements or discontinuation of the Service. Where reasonably practicable and lawful, we may provide notice or an opportunity to appeal.
12. Disclaimers and limits of responsibility
The Service is provided on an 'as available' basis. We seek to provide a safe and reliable experience but cannot promise uninterrupted availability, that every user is truthful, or that all harmful conduct will be prevented. To the maximum extent permitted by applicable law, FLAYR disclaims warranties that may lawfully be excluded.
To the maximum extent permitted by law, FLAYR is not liable for indirect, incidental, special or consequential loss arising from the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or overrides mandatory consumer protection rights. Any specific monetary liability cap should be set only after legal review.
13. Disputes and governing law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, subject to mandatory rights and jurisdiction rules that apply where you live. Before formal proceedings, you may contact legal@flayr.net to seek an informal resolution. Nothing here requires binding arbitration or waives rights to bring a class proceeding where such provisions would be unenforceable or inappropriate.
14. Changes to the Service or Terms
We may modify features or these Terms. We will publish the updated version with a new effective date and provide additional notice or obtain consent when required by law. Material changes will not apply retroactively where prohibited. Continued use after legally effective changes may constitute acceptance where permitted.
